Liability Waiver

I acknowledge and understand that my participation in the classes provided on the App is voluntary. I acknowledge and understand the scope, nature, and extent of the risks involved and expressly, voluntarily, and irrevocably assume any and all risks of loss and/or damage to property, illness, injury, and/or death arising from my participation in any class or classes, whether or not contemplated in this Agreement and regardless of how it was caused.

I acknowledge, understand, agree, and represent that I understand the nature of the activities to be undertaken in the App and that I am qualified, in good health, and in proper physical and mental condition to participate in such activities. I further agree and covenant that if at any time I believe that my participation in any class within the App would put me or other participants at risk of harm, I will decline to participate in such class, or if such class has commenced, immediately discontinue further participation. If I participate in a class on the App, I do so voluntarily and knowingly and I expressly assume any and all risks of property damage, personal injury, and/or death to me or other participants arising from my participation in such class.

I acknowledge and understand that I am fully responsible for managing myself, my actions, and my emotions in connection with any class I take on the App, and am solely responsible for all actions I take and things I say during any such class.

Under no circumstances, including, but not limited to, negligence, shall The Breath Source, The Breath Source’s subsidiary and parent companies or affiliates be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of, or the inability to use, the App, even if The Breath Source is advised beforehand of the possibility of such damages. (because some states do not allow the exclusion or limitation of certain categories of damages, the above limitation may not apply to me. In such states, The Breath Source’s liability and the liability of The Breath Source’s subsidiary and parent companies or affiliates is limited to the fullest extent permitted by such state law.) I specifically acknowledge and agree that The Breath Source is not liable for any defamatory, offensive, or illegal conduct of any participant. If I am dissatisfied with the App or any class offered thereon, Class, or any policies applicable thereto, my sole and exclusive remedy is to leave the class and/or discontinue use of the App.

The App offers health and wellness information and is designed for educational purposes only. I should not rely on this information as a substitute for, nor does it replace professional medical advice, diagnosis, or treatment. If I have any concerns or questions about my health, I should always consult with a physician or other health-care professional. I will not disregard, avoid or delay obtaining medical or health related advice from my health-care professional because of something I may have learned during a class or on the App. The use of any information provided by The Breath Source is solely at my own risk.
